Welcome to Airhaert Studio, a creative universe of sound, art, and education.
These Terms and Conditions apply when you visit airhaert.com or shop.airhaert.com, purchase an offering, submit an application, or participate in an Airhaert Studio program, including the Air Bending Sound Academy, also referred to as ABSA.
Please read these Terms carefully before using the website, purchasing an offering, or enrolling in a program.
1. Acceptance of Terms
By accessing this website, making a purchase, or entering into an enrolment agreement with Airhaert Studio, you acknowledge that you have read and agree to these Terms.
If you do not agree with these Terms, please refrain from using the website or purchasing its products and services.
These Terms apply to visitors, applicants, students, parents or legal guardians, newsletter subscribers, and customers of Airhaert Studio.
Certain products, programs, and services may include additional terms. If there is a conflict between these general Terms and a signed ABSA enrolment agreement or product-specific licence, the more specific agreement will apply, subject to any rights provided by law.
2. Products, Programs & Services
Airhaert Studio may offer:
Digital products, including sample packs, sound libraries, music, guides, templates, recordings, and educational materials.
Creative workshops, sound experiences, consultations, and educational sessions.
Private or small-group music education through the Air Bending Sound Academy.
Physical products, such as vinyl records, artwork, prints, certificates, or merchandise, when available.
Details about the content, format, duration, price, currency, and delivery of an offering will be provided on the relevant sales page, enrolment agreement, invoice, or checkout page.
Unless otherwise stated, prices are listed in CAD (Canadian Dollars). Applicable taxes and fees will be displayed or communicated as required.
3. ABSA Applications & Acceptance
Submitting an ABSA application expresses interest in the program. It does not guarantee acceptance, reserve a place, or create an enrolment contract.
Applications are reviewed to determine whether the program is aligned with the applicant’s goals, experience, scheduling needs, and preferred learning format.
Airhaert Studio may accept or decline an application when reasonably necessary to maintain the quality, safety, capacity, or intended purpose of the program.
An applicant becomes enrolled only after receiving written acceptance and completing the required enrolment process.
Accepted students will receive a separate enrolment agreement containing the specific program dates, duration, services, location or online format, tuition, payment schedule, cancellation rights, and other applicable conditions.
For students under the age of 18, a parent or legal guardian may be required to complete or approve the enrolment agreement, payment arrangements, and participation terms.
4. ABSA Tuition & Payment
ABSA tuition and payment dates will be stated in the student’s enrolment agreement.
Payments must be made according to the agreed schedule and through an accepted payment method. Airhaert Studio will provide the information and documents required by applicable consumer protection law.
Payment plans do not reduce the total tuition unless expressly stated. A student or parent who chooses a payment plan remains responsible for payments due for services provided, subject to any cancellation rights established by law.
A student’s access to ongoing services may be paused if a required payment remains outstanding, provided that doing so is permitted by law and consistent with the enrolment agreement.
5. ABSA Scheduling, Attendance & Missed Sessions
ABSA is designed as a structured educational process. Students are expected to attend their scheduled sessions consistently and arrive prepared to participate.
Session dates and times are agreed upon during enrolment. Student-requested rescheduling is not available.
If a student cannot attend a scheduled session, Airhaert Studio will provide the lesson in a recorded video format so that the student can continue with the program material. The scheduled session will be considered delivered and will not be moved to another date.
Students should provide notice of an absence as early as reasonably possible so the recorded lesson can be prepared appropriately.
Recorded lessons and accompanying materials are provided exclusively for the enrolled student. They may not be shared, published, sold, copied, or distributed without written permission.
If Airhaert Studio must cancel or significantly change a scheduled session, an appropriate alternative will be provided. This may include a rescheduled session, a recorded lesson, or another arrangement suited to the circumstances.
6. ABSA Cancellations & Refunds
Students may cancel their ABSA enrolment by sending written notice to Airhaert Studio.
Any cancellation, refund, or amount remaining payable will be handled according to the student’s enrolment agreement and applicable Quebec consumer protection law.
If a student cancels before the program begins, they will not be charged for services that have not started.
If a student cancels after the program begins, they may be responsible for the value of services already provided and any cancellation amount permitted by law.
Any refund owed following a cancellation will be issued within the legally required period.
A missed session is not considered a cancellation. The missed-session policy in Section 5 will apply.
7. Educational Expectations & Student Responsibility
Airhaert Studio provides education, creative guidance, feedback, and a structured process. Creative results depend on many factors, including participation, practice, available time, technical setup, experience, and personal circumstances.
Unless expressly guaranteed in a written agreement, Airhaert Studio does not guarantee:
Completion of a particular song or project.
A particular artistic, technical, financial, professional, or career outcome.
Employment, income, audience growth, recognition, publication, or commercial success.
Students are responsible for maintaining access to any equipment, software, internet connection, files, or materials identified as necessary for their program.
Technical support is limited to the scope of the program. Airhaert Studio is not responsible for failures caused by a student’s equipment, software, internet connection, incompatible systems, lost files, or third-party services.
Students are strongly encouraged to maintain backups of their creative work.
8. Digital Products & Licensing
Purchasing a digital product does not transfer ownership of the original recordings, compositions, files, artwork, videos, written materials, educational resources, or other intellectual property belonging to Airhaert Studio.
Unless permission or a specific licence is provided, you must contact Airhaert Studio before using, reproducing, adapting, publishing, distributing, licensing, or commercially exploiting its creative materials.
Sample packs are an exception. When you purchase an Airhaert Studio sample pack, you receive a non-exclusive, non-transferable licence to incorporate the included sounds into your own original musical works and live performances, subject to the licence provided with the product.
Sample-pack files may not be resold, redistributed, sublicensed, shared, uploaded, or made available as standalone sounds or as part of another sample pack, sound library, download collection, or similar product.
Use of Airhaert Studio samples in film or video-game projects or certain fashion projects requires separate permission and may require an additional licence. Please contact Airhaert Studio before using the samples for either purpose.
A product-specific licence will take priority if it contains additional or different conditions.
9. Digital Product Refunds
Due to the immediate-access nature of digital products, digital purchases are generally final once the files have been accessed or downloaded.
If a download link is broken, a file is corrupted, or you experience another technical access issue, please contact Airhaert Studio so that reasonable assistance or replacement access can be provided.
This policy does not limit any refund, cancellation, warranty, or consumer right that cannot legally be excluded.
10. Physical Products & Shipping
When physical products become available, applicable prices, shipping options, estimated delivery details, and return conditions will be provided at the time of purchase.
Orders may ship from Canada or through a production or fulfilment partner.
International customers may be responsible for customs duties, import taxes, brokerage costs, or other charges imposed by their jurisdiction.
Airhaert Studio is not responsible for delays caused by postal carriers, customs processing, incorrect delivery information provided by the customer, severe weather, or events reasonably outside its control.
Nothing in this section limits any legal warranty or consumer right provided by applicable law.
11. Intellectual Property
Unless otherwise stated, the content belonging to Airhaert Studio, including its music, artwork, photography, videos, designs, written materials, educational frameworks, recordings, branding, website content, and digital products, is protected by copyright and other intellectual property laws.
You may not copy, reproduce, modify, distribute, publish, teach, sell, or commercially exploit Airhaert Studio materials without written permission, except where expressly allowed by a purchased licence or applicable law.
The names Airhaert, Airhaert Studio, Air Bending Sound Academy, and associated visual identities may not be used in a way that suggests authorization, partnership, endorsement, or affiliation without written permission.
12. Student Work, Images & Recordings
Students retain ownership of the original music, recordings, writing, and artwork they create, subject to the rights of any collaborators and the licences governing sounds, software, or other materials used in the work.
Airhaert Studio retains ownership of its teaching materials, frameworks, lesson recordings, demonstrations, templates, exercises, and program resources.
Student work, testimonials, photographs, video footage, or recordings will not be publicly used for promotional purposes without separate permission from the student or, where applicable, their parent or legal guardian.
Permission to share student work may be withdrawn for future uses by contacting Airhaert Studio. Withdrawal may not affect materials already lawfully published or distributed before the request was received.
13. Respectful Participation
Airhaert Studio is committed to maintaining a respectful and creatively supportive learning environment.
Participants must not engage in harassment, discrimination, threats, abusive behaviour, deliberate disruption, infringement of another person’s intellectual property, or conduct that creates a serious safety concern.
Airhaert Studio may take reasonable action when these boundaries are violated. This may include providing a warning, limiting participation, or ending services, subject to the enrolment agreement and applicable law.
14. Third-Party Services
Airhaert Studio works with trusted third-party service providers to support its websites, purchases, payments, communications, scheduling, digital content, and educational programs.
Your use of a third-party platform may also be governed by that provider’s own terms, policies, and technical requirements.
Airhaert Studio is not responsible for an interruption, change, error, or security incident caused solely by an independent third-party service. Where reasonably possible, we will assist with access issues relating directly to an Airhaert Studio purchase or program.
15. Newsletter, Communication & Privacy
Joining the Airhaert Portal newsletter is optional and separate from submitting an ABSA application or enrolling in a program.
When you actively subscribe, you consent to receive emails about releases, products, workshops, programs, educational content, and creative updates.
You may unsubscribe from promotional emails at any time by using the link included in those messages.
Airhaert Studio may still send essential operational messages relating to an application, purchase, scheduled session, payment, or active program.
Personal information is handled according to the Airhaert Studio Privacy Policy.
16. Website Use
You agree not to use the Airhaert Studio websites to:
Attempt to gain unauthorized access to the website, accounts, files, or systems.
Introduce malicious code or interfere with the website’s operation.
Copy, scrape, extract, or republish protected content without permission.
Misrepresent your identity or impersonate another person.
Use the website for unlawful, fraudulent, abusive, or harmful purposes.
Airhaert Studio may restrict access when reasonably necessary to protect the website, its users, its creative work, or its services.
17. Disclaimers & Limitation of Liability
Website content and general educational materials are provided for creative and informational purposes. They are not legal, financial, medical, psychological, or therapeutic advice.
To the fullest extent permitted by law, Airhaert Studio is not responsible for indirect or consequential losses arising from the use of its website, digital materials, or services.
Airhaert Studio does not guarantee that its websites or digital services will operate without interruption or that every product will be compatible with every device, software version, or technical environment.
Nothing in these Terms excludes or limits liability, legal warranties, or consumer rights that cannot legally be excluded or limited.
18. Changes to Offerings or These Terms
Airhaert Studio may update its website, offerings, and these Terms as its creative universe evolves.
Changes will not retroactively alter the essential terms of an existing paid purchase or signed enrolment agreement without consent, unless a change is required by law.
The “Last Updated” date will identify the most recent version of these Terms.
19. Governing Law
These Terms and applicable transactions are governed by the laws of Quebec and Canada.
Any dispute will be addressed according to applicable law and before the court or authority with legal jurisdiction.
Nothing in these Terms restricts a consumer from exercising a right or remedy provided by mandatory consumer protection law.
